In order to find information if a certain design is or is not protected in Latvia, one should search three databases:
The database contains information on both – industrial design patents, filed under the provisions of the 1993 Law on Industrial Design Protection, as well as industrial designs filed under the provisions of the 2004 Cabinet Regulations on Industrial Designs or under the 2004 Law on Industrial Designs. Information on designs that have been filed but are not yet registered does not contain pictures.
Access to the database is free.
The database always contains up-to-date information. The information obtained from the database has no legal force. To obtain official extracts from the State Register of Industrial Designs please contact the Division of State Registers of the Department of Trademarks and Industrial Designs.
eSearch plus is a database of the European Union Intellectual Property Office that contains data on Community designs filed for registration under the Council Regulation (EC) No. 6/2002 of 12 December 2001 on Community designs. Community designs are valid in all 27 member states of the European Union, including Latvia.
The validity of Community designs of the transitional period, as well as their legal relations to the designs filed in Latvia, are governed by the novelty provisions of the above mentioned Regulation and Latvian legislation, as well as by Article 110a of the Regulation.
Hague Express is an industrial design database of the WIPO’s Intellectual Property Digital Library that contains information on designs filed for registration under the Hague Agreement Concerning the International Registration of Industrial Designs. In order to search for designs extended to Latvia you should enter the two-letter country code of Latvia “LV” in the field Designated Contracting Parties.
In order to find information if a certain design is protected, one can use the DesignView search tool.
DesignView search tool is intended to provide free access to design registrations from over 140 industrial property offices. The European Union Intellectual Property Office (EUIPO), the World Intellectual Property Organization (WIPO), as well as the African Regional Intellectual Property Organization (ARIPO) have also made their design databases available through DesignView.
