On 7 March 2023 entered into force the laws “Amendments to the Trade Mark Law” and “Amendments to the Law on Industrial Property Institutions and Procedures”, designed to transpose the requirements laid down in Article 45 of Directive (EU) 2015/2436 of the European Parliament and of the Council of 16 December 2015 approximating the laws of the Member States relating trade marks (“Without prejudice to the right of the parties to appeal to the courts, Member States shall provide for an efficient and expeditious administrative procedure before their offices for the revocation or declaration of invalidity of a trade mark”).
Amendments to the abovementioned laws provide the possibility for interested persons to submit to the Industrial Property Board of Appeal a notice for revocation or a declaration of invalidity of the registration of a trade mark.
